New laws for electric fencing in South Africa
A new legislation came into effect on the 1st of December 2012 stating that all new, upgraded and repaired electric fence installations done in South Africa, must be compliant with strict new regulations.
If your electric fence was installed by a general handyman for instance, chances are the fairly slim it was done to new legislative specification. By the 1st of October 2013, all electric fence installers must be registered, this after passing a not-so-easy exam. All new electric fences must now be certified with an electric fence system certificate of compliance, also known as an EFC. This certificate is very similar to the Electrical Compliance Certificates.
Take note that a qualified electrician who can issue the regular Electrical Compliance Certificate, can only issue an electric fence system compliance certificate , should he be registered with the Department of Labour to do so, being accordingly qualified in terms of the new electric fence laws.
An electric fence system certificate of compliance is also required when changes or additions are made to an existing installation. It is however, not required when repairing a broken wire, replacing a faulty bobbin or replacing the lighting arrestor or minor issues like that. Should your fence be found non-compliant, you will be forced to remove the fence or it will have to be upgraded to compliance standards.
The certificate however is transferrable; once it has been issued, there is no need to obtain a new one on a change of ownership. The electric fence system compliance certificate does not expire. Should a user fail to obtain an electric fence compliance certificate, it could result in a fine or a prison sentence of maximum twelve months. In case of a continuous offence, an additional fine of R200 for each day the offence continues or an additional one day imprisonment for each day the offence continues (provided the additional imprisonment shall not exceed 90 days).
To register, electric fence system installers must provide proof that they have successfully completed a “skills programme on Electric Fence System Installers from the Energy & Water Sector Education & Training Authority”. This is where it gets tricky, as currently, according to a document from the South African Electric Fence Installers Association, there are no government training programmes for this purpose yet. In addition to your personal details, ID photos and a signature sample, the Department of Labour also requires payment from the installers in the amount of R120.
